The Delhi High Court has granted interim relief to the children of Karisma Kapoor—Samaira and Kiaan—in their ongoing legal battle over the assets of their late father, Sunjay Kapur.
Justice Jyoti Singh directed that the estate of Sunjay Kapur must be preserved in its current state until the dispute is fully resolved. The court has restrained his third wife, Priya Kapur, from selling, transferring, or otherwise dealing with specific assets.
The case arises from a petition filed by Samaira and Kiaan, who are seeking their rightful share as Class-1 legal heirs. They claim entitlement to one-fifth each of Sunjay Kapur’s estate, which includes movable and immovable assets.
The court observed that there are unresolved doubts surrounding the validity of the will presented by Priya Kapur after Sunjay’s death. It ruled that the burden of proving the authenticity of the will lies with her and must be addressed during the trial.
Given the potential duration of the legal proceedings, the court has emphasized the need to protect the estate in the interim. As part of its order, Priya Kapur has been restricted from:
- Selling or altering shares in three Indian companies
- Disposing of artworks
- Moving funds from certain bank accounts
- Using Sunjay Kapur’s foreign bank accounts
The dispute also involves Sunjay Kapur’s mother, Rani Kapur, who has raised questions about the legitimacy of the will.
Sunjay Kapur passed away in the United Kingdom on June 12, 2025, after suffering a heart attack during a polo match. His death has since led to a complex legal battle over his estate.
With the court’s interim order now in place, the focus shifts to the upcoming trial, where the authenticity of the will and rightful ownership of the assets will be determined.
